I have no children myself, but a friend of mine has a teenager with borderline personality disorder and can get violent. To what extent can a parent fight back in defense without being arrested or have CPS called on them.

Also, if the child is taken to juvee for assault how long can they expect to stay there?

Well I would say that a parent should never FIGHT back but they should grab ahold of the child’s wrists and step on their feet so they cant kick. Hold them their until they calm down and just repeat this process whenever they get violent

It depends on what state you live in as to the question of staying in Juvenile detention for an assault. Some states have mandatory sentencing laws. I have been told that you may do what you need to and if it does not leave marks than you are OK. That seems rather general and not very helpful though. Just because CPS is called does not mean that they will find assault there if there isn’t any. Often times they can connect you with resources that you wouldn’t know about otherwise. You have a right to defend yourself, that is to say to stop someone from attacking you, but many people go overboard and continue the assault just to make sure their assailant is down. (You probably don’t want to do that with your kid.)

Mine drew back on me when he was 13. After he woke up he wanted to call the police, so i told hiim go ahead, but remember…they aint outside the doors so expect more of what u just got. I’ll give the cops a GOOD reason to take me. ….that was 6 yrs ago and we still laugh about it when he comes home from college. Never had any problems with him after that.

how old is the teenager? you cannot physically fight back. you can only protect yourself. that means that you can pick up something to put in between you and them so that they cannot hurt you. if possible call the police for assistance. have the teenager arrested. if the teenager is 18 or 19 then you can physically fight them back without any repercussions against you. it is called self defense. have them arrested. do not bail them out quickly. maybe a little time in jail will get the message through to them. it is called TOUGH LOVE! when you do bail them out let them know that there are new house hold rules for them to follow.
